The Unified Patent Court (UPC) — Europe’s specialised patent court, launched in 2023 — has changed the game. Before it, enforcing a patent across Europe meant suing country by country. Now, one action can produce an injunction covering most of the EU at once. A recent case shows exactly how powerful that is.
One ruling, four countries, an entire product line gone. Germany’s Fraunhofer institute (famous for the MP3 and AAC audio codecs) secured a pair of UPC injunctions against phone maker HMD over standard-essential audio patents — covering Germany, France, Italy, the Netherlands and Belgium. The result: HMD pulled its entire smartphone range from those markets, leaving only basic feature phones on its web shops. A single set of injunctions became a multi-country sales ban.
Why this matters for any business selling in Europe:
It cuts both ways. For a patent owner, the UPC is a formidable weapon — block a competitor across most of Europe in one stroke. For a company selling products, it’s a single, continent-wide risk: one adverse ruling can shut you out of the entire market simultaneously. No more losing one country while keeping the rest.
Standard-essential patents give enormous leverage. Many of these fights involve patents essential to a technical standard (connectivity, audio, video). The threat of a pan-European injunction forces implementers to the table: take a licence on “FRAND” terms, or be blocked across Europe. Being labelled an “unwilling licensee” is often fatal.
Germany dominates, and injunctions come readily. Around three-quarters of UPC cases are filed in Germany, whose courts are fast and grant injunctions without heavy “proportionality” analysis — making Europe a magnet for patent enforcers, including non-practising entities (“patent trolls”).
The takeaway: patent risk in Europe is no longer a country-by-country problem — it’s a single, all-or-nothing exposure. For any business selling technology products into Europe, freedom-to-operate analysis, standard-essential-patent licensing, and a UPC strategy are no longer optional. You can be knocked out of an entire continent in one ruling — and, as HMD just showed, it happens fast.
